Companies Agree to Resolve False Claims Allegations

On August 25, 2020, the U.S. Attorney’s Office for the Eastern District of Pennsylvania filed a civil Complaint against Shaver Foods LLC and Zilka & Company LLC.  According to the Complaint, between at least 2017 and the present Shaver Foods and Zilka knowingly presented and/or caused to be presented materially false and fraudulent claims for payment to the BOP in violation of the False Claims Act by supplying spices manufactured by Zilka that contained additives and fillers, contrary to the contract specifications entered into by Shaver Foods.  On August 26, 2020, the U.S Attorney’s Office entered notice in the Eastern District of Pennsylvania that the companies had settled the complaint.  The investigation was conducted by the OIG’s Fraud Detection Office and the Food and Drug Administration Office of Criminal Investigations.
