USER FEE ADVISORY COMMITTEE CHARTER AND MEMBERS


IMMIGRATION AND NATURALIZATION SERVICE USER FEE ADVISORY COMMITTEE

CHARTER

Pursuant to Section 205 of the Department of Justice Appropriations Act of 1986, a standing advisory committee is hereby reestablished in accordance with the provisions of the Federal Advisory Committee Act with the purposes and provisions set forth hereinafter.

  1. OFFICIAL DESIGNATION: The official designation of this advisory committee is the "Immigration and Naturalization Service User Fee Advisory Committee," hereinafter "Advisory Committee."

  2. AUTHORITY: This Advisory Committee is reestablished under the authority of Section 286(k) of the Immigration and Nationality Act of 1952, as amended by the Department of Justice Appropriations Act of 1986 [P.L. 99-591; enacted October 30, 1986], (8U.S.C. 1356(k)); and the delegation of authority under 28 C.F.R. 0.105. This Advisory Committee is reestablished in accordance with the provisions of the Federal Advisory Committee Act [5 U.S.C. Appendix].

  3. DUTIES, OBJECTIVES, AND SCOPE OF ACTIVITY: The responsibilities of this standing Advisory Committee are to advise the Commissioner of the Immigration and Naturalization Service, hereinafter "INS," on issues related to the performance of airport and seaport immigration inspectional services. This advice should include, but not be limited to, such issues as the time period during which such services should be performed, the proper number and deployment of inspection officers, the level of fees, and the appropriateness of any proposed fee. These responsibilities are coincident to the assessment of an immigration user fee.

  4. ADMINISTRATIVE RESOURCES AND SUPPORT: The INS shall provide the necessary administrative support to this Advisory Committee. The estimated operating costs of this Advisory Committee are limited to $45,000 per year. The estimated staff-years for operation of this Advisory Committee are 0.33 per year.

  5. MEETINGS: This Advisory Committee shall conduct meetings approximately every 6 months in accordance with the provisions of the Federal Advisory Committee Act and implementing regulations. The meetings of this Advisory Committee shall be chaired by the INS Commissioner or his or her designee.

EXECUTIVE SUMMARY

The Charter for the Immigration and Naturalization Service User Fee Advisory Committee was signed by the Commissioner on December 28, 1998. The Federal Advisory Committee Act provides that a new charter must be filed upon the expiration of each successive 2-year period. The enclosed memorandum to the Attorney General requests approval to renew the charter.

PURPOSE:To obtain approval from the Attorney General of INS' request to reestablish the Charter of the INS User Fee Advisory Committee.
TIMETABLE:Charter expires on December 28, 2000
DISCUSSION:The INS User Fee Advisory Committee was first established in 1986. Section 14(b)(2) of the Federal Advisory Committee Act provides that a new charter must be filed upon the expiration of each successive 2-year period. A copy of the new Charter is attached for your review and approval.
RECOMMENDATION:    INS recommends that the Attorney General approve the
reestablishment of this Committee.
