FBI Subcontractor Sentenced for Bribery of a Public Official

On May 5, 2021, a non-DOJ federal sub-contractor was sentenced to 18 months of imprisonment, three years of supervised release, and ordered to pay a $100,000 fine for one count of bribery of a public official.  Robert Bailey was sentenced in the District of Idaho.  According to the factual statement in support of the guilty plea, from in or about 2016 through in or about 2018, Bailey directly, with the intent to influence a public official within the FBI who was responsible for the administration of FBI contracts, provided the FBI employee $120,000, a beach house rental, sports tickets, a fiftieth birthday party, and other items of value in exchange for the FBI official recommending that the FBI directly pay the full lodging per diem payments for Bailey’s company employees who stayed in Bailey’s residence; providing a draft Statement of Work for a bridge contract for the FBI’s Pocatello Data Center project to Bailey, whose company was a subcontractor of a company that was bidding on the contract, and incorporating Bailey’s edits in the final bridge contract; and advocating for increased labor rates for the bridge contract that would benefit Bailey’s company, among other official acts.  The investigation was conducted by the OIG’s Denver Field Office and the Internal Revenue Service – Criminal Investigation Division; forensic assistance was provided by the OIG’s Cyber Investigations Office.
